La loi nationale entre ciel et terre

National law between heaven and earth

Abstracts

National law between heaven and earth. -- Law and legal practices in Morocco have three main sources-- customary, Muslim and national --each with geographically and socially distinct scopes despite overlapping. Customary law is waning in importance even though it still governs many social relations in rural areas. Moreover, national law has proven to be rather ineffective. This has serious consequences since the law is not strictly upheld and, furthermore, objections are being raised to the legitimacy of the principle of legality, which is the very ground of national law.
